DWI East Fishkill Man Had Child On Board In Rollover Crash, Sheriff Says

An East Fishkill man is behind bars after crashing his vehicle while drunk with an 8-year-old passenger, according to the Dutchess County Sheriff's Office.

Johnny J. Symes, 52, was arrested following a single-vehicle rollover crash around 5:53 p.m. Sunday on New Hackensack Road in the Town of LaGrange, deputies said.

Deputies said Symes drove a 2003 Honda off the east side of the road before hitting an embankment and overturning. Neither Symes nor the child were injured.

Symes was charged with DWI with a blood-alcohol level of .08 percent or more, aggravated DWI and aggravated unlicensed operation, all felonies, the department said.

He was also charged with driving a vehicle without a court-ordered ignition interlock device, a misdemeanor, and a traffic infraction, officials said.

The charges were felonies due to Symes having a prior DWI related conviction within the prior ten years, which was August 2017 in the Town of Poughkeepsie. Having a child less than 16 years of age in the vehicle while he was in an intoxicated condition, and because his license was revoked for a DWI-related conviction, and he was intoxicated while operating the vehicle.

He is being held without bond at the Dutchess County Jail until his first court appearance later Tuesday.
