The 14-year-old girl told Yorktown Police the day after the party that she was sexually attacked during a party that included a group of freshman high school students, said Yorktown Police Lt. Tom Genter after the event.
As previously reported by Daily Voice, the male teens were charged with juvenile delinquency as a result of the incident at the party on Sunday, Oct. 30, were not hit with stiffer charges because of their age and the fact that the attack did not qualify as first-degree rape, according to the Westchester County District Attorney's Office.
"The crime would need to meet the qualifications for first-degree rape before they would be charged under adult criminal statutes," Robert Wolf, District Attorney's Office spokesman, told Daily Voice. "Currently, the matter will be handled in family court."
Since the event, the girl claims that she has been bullied and harassed by her classmates at school to the point that she had to withdraw and is being homeschooled, reported lohud.com. School officials are offering little information, citing privacy laws, added lohud.com.
Both teens were arrested Nov. 1 and released to their parents.
"The party was not school-related in any way," Genter said at the time of the arrests. "It was just a group of kids having a party."
Genter added there was no indication that drugs or alcohol played a part in the alleged attack.
