Troopers were patrolling North Division Street in Peekskill at approximately 2:30 a.m. on Saturday when they observed a 2014 Honda CRV traveling 48 in a 30 MPH zone and conducted a traffic stop on the vehicle, according to police.
The troopers' investigation revealed that Garcia was intoxicated and was operating the vehicle with his wife and two children, ages 13 and 2, as passengers, police said.
Chavez Garcia was placed in custody and transported to the State Police Cortlandt Barracks where he submitted a breath sample of .08 percent, police said.
Chavez Garcia was charged with Felony DWI (with a previous conviction within 10 years) Leandra's Law (a felony for having a child passenger under the age of 16) and speeding.
Chavez Garcia is currently awaiting arraignment in the City of Peekskill Court, according to police.
