Montrose Man Stopped For Speeding Facing Multiple Drug Charges

Three Westchester residents were arrested for heroin, suboxone, and marijuana possession after the vehicle they were driving in was stopped for speeding on I-87 in upstate New York on Saturday morning.

The driver of the vehicle, James D. Tobin, 27, of Montrose, and his passengers, Thomas Johnston, 48, of Valhalla  and Taniah D. Cousins, 21, of Mount Vernon, were found to be in possession of heroin, suboxone film strips (used to treat opiate addiction) and marijuana after the stop, which occurred around  9:36 a.m. in Bethlehem, just south of Albany.

Tobin was charged with:

  • Criminal possession of a controlled substance in the fifth degree, a Class D felony
  • Criminal possession of a controlled substance in the seventh degree, a Class A misdemeanor
  • Tampering with physical evidence, a Class E felony
  • Controlled substance not in original container, public health law violation
  • Unlawful possession of marijuana, a violation
  • Speeding vehicle and traffic violation

He was arraigned before the Town of Bethlehem Court and remanded to the Albany County Jail in lieu of $50,000 cash bail or bond. 

Johnston was charged with:

  • Criminal possession of a controlled substance in the fifth degree, a Class D felony
  • Criminal possession of a controlled substance in the seventh degree, a Class A misdemeanor
  • Tampering With Physical Evidence, a Class E felony
  • Controlled substance not in original container, public health law violation

He was arraigned before the Town of Bethlehem Court and remanded to the Albany County Jail without bail.

Cousins was charged with:

  • Criminal possession of a controlled substance in the fifth degree, a Class D felony.
  • Criminal possession of a controlled substance in the seventh degree, a Class A misdemeanor
  • Tampering with physical evidence, a Class E felony
  • Controlled substance not in original container, public health law violation

She was arraigned before the Town of Bethlehem Court and remanded to the Albany County Jail in lieu of $10,000 cash bail or bond.
