Report: Appeals Court Orders Resentencing of Croton Man In Slaying

CROTON, N.Y. -- An appellate court recently set aside the verdict in the 2009 Croton-on-Hudson incident in which a man beat his girlfriend to death with a baseball bat, according to a report on

Robert Sepe "could be freed from prison as soon as this year" after the appellate court ordered that Sepe be "resentenced," according to the report on Sepe was convicted of murdering 41-year-old Janette Carlucci in 2009, according to the report .

Appellate Division Judge Jeffrey Cohen wrote that "it was Janette Carlucci’s refusal to cancel an Easter dinner that set off an aluminum bat attack in what the justices described as an 'extreme emotional disturbance' mitigating Sepe’s conduct' — the exact defense jurors had rejected, according to the report.

Cohen ordered the conviction be reduced to five to 25 years for manslaughter, according to the report. With Sepe already having served more than five years, he could be freed when resentenced, according to the report.
