Driver In Crash That Killed Peekskill Man Seeks Delay Of Civil Suit

PEEKSKILL, N.Y. -- The truck driver accused of crashing into a limousine on the New Jersey Turnpike that killed a Peekskill man and injured actor Tracy Morgan is seeking a delay in the civil lawsuit in the case, according to NJ.com.

Kevin Roper was driving a Wal-Mart truck in June when it was involved in a six-vehicle accident on the New Jersey Turnpike. James McNair of Peekskill, 62, was riding in the vehicle with Morgan and three other friends of Morgan.

Roper has been charged in state court with vehicular homicide and four counts of assault by auto. He has filed to delay a separate negligence lawsuit Morgan filed against Wal-Mart, arguing the pending civil proceedings would violate his rights under the Fifth Amendment against self-incrimination, according to the NJ.com report.
